INTRODUCTION

Ashok is a Solicitor admitted to the roll in 2010 and Advocate enrolled in India in the year 2002. He specialises in public and human rights law with an emphasis on UK Immigration and Nationality law. His expertise extends to matters relating to Contracts, Intellectual property rights, Possession of property at County Courts and drafting Wills.

QUALIFICATIONS & MEMBERSHIPS

To enhance his professional career he earned a Master’s degree in Law from a reputed University from Scotland with specialisation in International Commercial Law, Dispute resolution and international human rights Law. He is also a qualified Advocate in India and is a member of the Indian Bar Council since 2002.
Ashok has been providing affordable legal advice and representation to both EU and non-EU individuals, family and companies in the UK. He advises clients across a range of immigration matters, including entry clearance applications, in country leave to remain applications, administrative reviews, appeals against Home Office refusal decisions, permanent residency and naturalisation applications.

His expertise covers all aspects of corporate immigration law including applications under various tiers (Tier 1, 2, 4 & 5) of the Points-Based System, entry clearance applications. He has advised extensively on all aspects of immigration for UK employers who are licensed sponsors under Tier 2, 4 and 5 of the PBS and also on objections/appeal against the Notice of civil penalties. His corporate immigration expertise includes assisting employers to manage their Sponsor management System, in view of prevention of illegal working and risk management strategies he regularly conducts compliance audit visits and provides strategic advice on their sponsorship licence in line with the Home Office guidance on sponsor compliance and duties, action plans, license re-rating, right-to-work checks and also assists on the recruitment of individuals or transfer of employees both from within UK and abroad. He further assists with sponsorship following acquisition of companies and the transfer of their employees under TUPE regulations.

Ashok has had notable success in advising high net worth immigration clients on a number of complex initial and extension applications under Tier 1 (Entrepreneur, Investor and exceptional talent) clients and applications for accelerated settlement under these routes.

Kumar has acted in the acquisition of a commercial freehold property for £1.2 million which also involves franchises from WHSmith, Post Office & a reputable retail business.

Ashok acts for a broad range of clients in the UK and overseas from private clients to MNCs, business & management consultancies, software/ IT contractors, logistics industries, oil & gas companies, construction companies, food industries, NHS trust recruitment agencies, GP practices, telecommunication companies, pharmacies, Care Homes, religious/charitable organisations, clothing wholesale companies, export & import, jewelleries and also retail businesses. Ashok also advises clients on Indian Laws relating to transfer of property, Power of Attorney, Business Agreements for Indian investors in the UK business.

He continues to update knowledge in his areas of practise in order to ensure competency in the profession. He attends annual conferences, seminars by notable Barristers including Queen’s Counsels, interactive master classes and also regularly interacts with industry experts.

Ashok is dual qualified having enrolled as an Advocate in Bar Council of India and practised in that jurisdiction both on Contentious & Non- Contentious matters.

He has been a member of Law society of England & Wales, Bar council of India and Society of Asian Lawyers.

Ashok advises clients on judicial review matters challenging Secretary of State’s unlawful decisions, including decision of Revocation of sponsor licence, at the Upper Tribunal and Admin Court division of the Royal Courts of justice. He has also sought interim relief on urgent consideration basis and successfully obtained interim relief for clients. He has experience in instructing junior/senior Counsels and QCs on many notable cases in relation to revocation of sponsor licence by secretary of state for the home department.

Ashok has handled numerous number of complex cases in the Immigration appeal proceedings at the First Tier and Upper Tribunals, Judicial Review claims, both in the Upper Tribunal and the Administrative Court, and cases in the Court of Appeal. With significant experience in immigration, he is active in resolving post-conviction removal/deportation cases, bail applications, adult dependent relative appeals, cases under Appendix FM as well as Article 8 of European Convention on Human Rights (ECHR), European Economic Area (EEA) appeals for both family and extended family member.

He has experience & expertise in protecting client’s Intellectual property rights, filing applications with UK IPO, European (OHIM) and WIPO and enforcing clients’ Intellectual Property rights against infringers. He has acted for software companies on the registration of Trade Mark, software source registration code. He has also advised many clients on the terms and effect of the settlement agreement in disputes relating to IP matters.
